Si bien la mayoría de los gobiernos de Medio Oriente y África del Norte han expresado su apoyo a la CPI, pocos han tomado las medidas necesarias para ratificar o adherirse al Estatuto de Roma.
Implementación es la adopción de legislación nacional por parte de un Estado para cumplir con el objetivo general de poner “fin a la impunidad (…) por los delitos más graves que preocupan a la comunidad internacional en su conjunto” (cf. Preámbulo del Estatuto de Roma).
La región de Asia y el Pacífico sigue siendo la menos representada en el sistema del Estatuto de Roma. Aunque la región alberga aproximadamente el 60% de la población mundial, solo 19 de los 55 países de Asia y el Pacífico son Estados Parte de la CPI.
La universalidad del sistema del Estatuto de Roma de la CPI puede ser alcanzada una vez que todos los Estados decidan ratificar o adherirse al Estatuto de Roma de la CPI.
El Estatuto de Roma establece la obligación de cooperar plenamente con la CPI (art. 86), así como de adoptar procedimientos internos para la cooperación (art. 88). La Parte 9 del Estatuto de Roma establece las obligaciones de los Estados Partes hacia la Corte.
Todas estas enmiendas extienden el mandato de la CPI sobre crímenes de guerra presuntamente cometidos por nacionales o en el territorio de un Estado Parte de la CPI no concebidos originalmente en el Estatuto de Roma adoptado en 1998.
