The Challenge: Child Marriage is not Tradition, it's a Violation of Human Rights

Marriage before the age of 18 is a fundamental violation of human rights. Many factors interact to place a child at risk of marriage, including poverty, the perception that marriage will provide ‘protection’, family honor, social norms, customary or religious laws that condone the practice, an inadequate legislative framework and the state of a country’s civil registration system. While the practice is more common among girls than boys, it is a violation of rights regardless of sex. (Source: UNICEF).

Each year, 12 million girls – across countries, cultures and religions – are married before the age of 18. This practice violates girls’ rights to health, education and opportunity, exposes girls to violence throughout their lives and traps them in a cycle of poverty (Source: Girls Not Brides).

The Response: the CEFM Campaign

The Campaign to End Child, Early and Forced Marriage (CEFM) was launched in 2014. It seeks to empower parliamentarians to become leaders in the defense and promotion of the human rights of girls and women. This includes promoting an effective monitoring, funding and implementation of Sustainable Development Goal (SDG) 5: To achieve gender equality and empower all women and girls, particularly by addressing target 5.3 on ending all harmful practices such as child, early and forced marriage.

To achieve this goal, the CEFM Campaign pursues the following outcomes:

  1. Encourage parliamentarians to effectively address child, early and forced marriage and early unions and include these issues as priorities in their parliamentary agendas.
  2. Build political support to create an enabling legal and policy framework that:
    • Asserts the primacy of national laws over customary and religious laws;
    • Establishes 18 as the minimum legal age for marriage, uniformly for both boys and girls, with no exceptions;
    • Strengthens civil registration (births and marriages), health and education systems; and
    • Guarantees the enjoyment of sexual and reproductive health and rights, property rights and access to justice for all girls and women.

The bill also remove provisions for consent to marriage of infants to be given by parents or guardians.

On 12 November, the House of Representatives of Belize unanimously approved the Marriage (Amendment) Bill to change the legal age of marriage from 16 to 18 years old. Hon. Valerie Woods, Speaker of the House of Representatives (Belize) Belize has taken a historic step by amending its laws to set the legal age of marriage at 18, strengthening protections for children and advancing gender equality. With unanimous support from all parties and representatives in the National Assembly of Belize, the country has reiterated its commitment to the rights of children. Much appreciation and recognition are due to the cohort of the national children’s parliament who in 2023 championed and called for this change by parliament in their annual program. In 2024, Parliamentarians heeded the call and with the passage of this legislation, the youth in Belize demonstrated the power of their voices to influence meaningful, transformative change. Hon. Janelle Chanona According to Unicef, over the past 10 years, the prevalence rate of child marriage and early unions has remained stagnant in Latin America and the Caribbean. Addressing child, early and forced marriage has not been an important component of national development agendas and public policies. Only 13 governments out of the 33 in the region have prohibited marriage under 18 years without exceptions. Parliamentarians have a fundamental role to play to: Effectively address child, early and forced marriage and early unions and include these issues as priorities in their parliamentary agendas. PGA Celebrates International Day of the Girl Child Today, we commemorate the International Day of the Girl Child.  As we reflect on this year's theme, Girls' Vision for the Future, let us commit to a future in which we give our girls a seat at the table, and provide them with access to education, healthcare and all of the resources they need to lead happy, healthy and productive lives. On this #InternationalDayoftheGirlChild, we extend our solidarity to girls around the world and commit to defend and protect their rights. Hon. Legislative Assembly of El Salvador Bans Child Marriage

The Legislative Assembly of El Salvador unanimously approved reforming its Family Code to prohibit marriage among minors.

New York, NY August 23, 2017: Parliamentarians for Global Action (PGA) congratulates the Legislative Assembly of El Salvador for unanimously approving a reform to its Family Code to prohibit marriage among minors. The bill, approved on August 17 in plenary session and on August 16 in the Committee on the Family, Childhood, Adolescence, the Elderly and Persons with Disabilities, will enter into force eight days after its publication in the country’s official journal. With this reform, El Salvador unequivocally establishes 18 as the minimum age of marriage with no exceptions, and joins its Central American neighbors, Panama, Costa Rica, Honduras and Guatemala – the latter repealing the exceptions in its Civil Code on this same date – that have taken steps to prohibit child marriage in their legislative frameworks. PGA, in collaboration with its National Group in the Legislative Assembly of El Salvador, and with support from UN Women and UNICEF, convened the Legislative Forum “Sharing Experiences and Best Practices in Latin America and the Caribbean to Prevent and Eliminate Child Marriage and Early Unions,” on July 5th in San Salvador, where PGA Board member Dip. Ronny Monge (Costa Rica), Dip. Gloria Reyes (Dominican Republic) and Dip. Soledad Buendía (Ecuador), shared their experiences on addressing child marriage with their Salvadoran peers. During this Legislative Forum, the Chair of the Committee on the Family, Childhood, Adolescence, the Elderly and Persons with Disabilities and its members, as well as members of the Committee on Women and Gender Equality and other Committees, vowed to analyze and discuss the proposal to prohibit this harmful practice in their next parliamentary session. After the successful approval of this reform in the Legislative Assembly of El Salvador, PGA Board Member Dip. Karina Sosa, Chair of the Committee on Foreign Affairs, Central American Integration and Salvadorans Abroad, stated: We are incredibly satisfied with the adoption of this bill and would like to express our gratitude and recognition to the commitment and support from the United Nations agencies and non-governmental organizations, such as PGA and Plan International, in accompanying us to begin transforming this reality that our children and adolescents, especially our girls, have lived through. Today, we have given a firm and forceful step to uphold the rights of children in line with the obligations assumed by El Salvador when we ratified the Convention on the Rights of the Child in 1990. Dip. Mario Tenorio, Chair of the Committee on Legislation and Constitutional Affairs and Chair of PGA’s National Group in El Salvador, said: We are very pleased that El Salvador stated last week that minors below 18 years of age will not be able to get married under any circumstance. With this decision, we are taking a very important step to prohibit child marriage in our country. This is a key step in guaranteeing and protecting the rights of the child. Members of Parliamentarians for Global Action supported this initiative and we pledged to end child marriage. Our commitment is always with PGA in support of these efforts aimed at protecting the rights of our children. Learning about the decision of the Legislative Assembly, Dip. Reyes from Dominican Republic indicated: I celebrate this development in defense of the rights of minors in El Salvador with the end to child marriage in their legislation. Global Parliamentary Declaration to End Child, Early and Forced Marriage & List of Signatories

The international community has pledged to end child, early and forced marriage (CEFM) as expressed in the Resolution on this issue adopted at the UN General Assembly in December 2014.

The international community has pledged to end child, early and forced marriage (CEFM) as expressed in the Resolution on this issue adopted at the UN General Assembly in December 2014. As democratically-elected Members of Parliament from around the world, we join this pledge to support the inclusion of a strong target to end child, early and forced marriage in the post-2015 development framework and commit to ensure its implementation in our countries. We are deeply concerned that child, early and forced marriage is a violation of human rights and a development challenge that prevents approximately 15 million girls every year, and their countries, from achieving their potential. Furthermore, we note with dismay that the practice has impeded the achievement of current Millennium Development Goals, as it perpetuates cycles of poverty, undermines efforts to reduce the numbers of women and children dying in childbirth and infancy, and holds back girls from attending school and contributing to their countries’ economic development and prosperity.  2015 is a defining moment as current negotiations for a post-2015 development framework will determine the international agenda and its priorities for the next fifteen years. As Parliamentarians, we choose this opportunity to rally around a concrete target on child, early and forced marriage not only as a way to reduce violence against women and girls, but also to spur progress towards a whole range of associated health, economic and educational goals. To achieve a life of dignity for all and leave no one behind, as UN Secretary General’s synthesis report on the Sustainable Development Goals (SDGs) emphasizes, the practice of child, early and forced marriage must be ended everywhere. As Parliamentarians, it is our duty to empower, protect and promote the human rights of all individuals in our countries, especially those most vulnerable. Therefore, we raise our voices and commit: As leaders, to use our platform and visibility to call on our Foreign Ministers to include a strong target to end child, early and forced marriage in the post-2015 development framework and to raise awareness in our constituencies and, with our colleagues in Parliament, of the value of the girl child, the importance of keeping girls in school, including pregnant and young mothers, and alternatives to child, early and forced marriage that benefit the child, the community and the country. As lawmakers, to create an enabling legal and policy framework for addressing child, early and forced marriage in our countries that asserts the primacy of national law over religious and customary laws, establishes 18 as the minimum and uniform age of marriage for both boys and girls, strengthens birth registration systems, and protects women and girls’ rights, including sexual and reproductive health and rights, property rights, and access to justice. In our oversight capacity, to invite our Foreign Minister, and other relevant Ministries, for a briefing on priorities for the Sustainable Development Goals’ negotiation process and stress that child, early and forced marriage must be comprehensively and strategically addressed in the post-2015 development framework. Additionally, and following the adoption of the SDGs, monitor the implementation as well as the allocation of resources to new and existing policies and laws that address child, early and forced marriage to ensure their effectiveness. We, the undersigned Parliamentarians, hereby call upon our Foreign Ministries, fellow Parliamentarians, and relevant stakeholders to redouble efforts in the months ahead to ensure the post-2015 development framework includes a strong target to end child, early and forced marriage under a gender equality goal. Ending child, early and forced marriage will result in fewer girls dying in childbirth, more children surviving infancy, more girls attending school, and will place us on a path to a more equal and more prosperous future, leaving no one behind. How We Work

Supported by an expert Secretariat, PGA members work together to educate, sensitize, build technical capacity, and strengthen the political will of parliamentarians to achieve campaign objectives through concrete legislative and policy initiatives. PGA works with individual parliamentarians in their national contexts through country-specific strategies, leveraging that capacity with international networking to facilitate connections among parliamentarians and build bridges with civil society, domestic and international policy-makers, and other stakeholders.
